(Canonically, she was under age at that time, so um, yeah, not good)
An alternate scenario I've made in my head to make Theseus less of a creep is that Helen had sent a message in a bottle asking to be rescued, and thus Theseus and Pirithous 'rescued' her from the brewing turmoil in Troy, and put her in the care of Theseus's mother.
